Describe the legal framework that is provided for the employment contract free essay sample

Employment contracts are encased by many legal frameworks which significantly influence the how the contracts are interpreted and enforced. These legal frameworks include tests used by courts to determine who is an employee and how these tests were altered by the Pointe-Claire v. Quebec case trialed by the Supreme Court of Canada, and aspects of contract law which govern the establishment of employment contracts. It is critical to determine who is an employee and who is an independent contractor because not only do most protective employment statutes pertain only to employment contracts (England, 2008, p. 16), but an employee has certain obligations under various legislation including the Income Tax Act, the Employment Insurance Act, the Canada Pension Plan Act, the Employment Standards Act, the Workers Compensation Act, and the Labour Relations Code 9or the Canada Labour Code if the employee is regulated federally). Employees are also protected by the â€Å"reasonable notice† of termination of employment entitlement under the common law unless the employment contract includes an express provision regarding termination (Flanagan, Ravary Boyd, 2005, p. 1). Courts within Canada establish employee status by using a variety of tests; however three components are commonly exercised when coming to a decision. Courts conclude that an employer must demonstrate a high level of bureaucratic control over employment in regard to the where and when it occurs; a worker must be economically reliant on an employer; and a worker cannot be an entrepreneur operating a business, but must form a portion of the employer’s organization. The demonstration of control is essential to the employment relationship due to the subordination of the employee to the clout of the employer. Economic reliance showcases the central policy of protective employment legislation, which, essentially, shelters susceptible employees. The requirement of an employee being an integral part of the employer’s business operations, rather than being an entrepreneur is required since protective employment statutes and common law severance requirements are intended to protect employees from possible mistreatment by employers (England, 2008, p. 19). The most popular formulation, however, is Lord Wright’s â€Å"fourfold test†. This test is commonplace because it is believed that a single test does not accurately consider complicated conditions of modern day industry, leading to the development of more intricate means of determining if a party is an employee or in business for themselves. A fourfold test would be more appropriate is cases involving the level of control demonstrated by the party over the scheduling and conduct of work performance; whether the party possesses the tools, supplies, or equipment used to perform the work; whether the party has an opportunity to profit; and whether the party could experience a loss. These elements determine the employment relationship by formulating if the party is performing the work for their own behalf or for a superior. Lord Denning’s business integration test is another widely used formulation. This approach believes that under a service contract, a party is employed as part of the business and their work is performed as an important part of the business. Under a contract of services, a party’s work only assists the business rather than being an integral part of operations. Many factors are assessed under this method to determine whether the party is an employee or an independent contractor. Ownership of tools and equipment insinuates independent contractor status if the party has made a generous investment in tools and equipment, and implies employee status if only a small amount of capital was invested. The possibility of economic gains and losses is also considered, meaning a party with a considerable investment in the business (beyond their labour) is generally considered to be an independent contractor rather than an employee. The regularity of employment is another key factor since if a party works solely for one employer, the party is considered to be an employee whereas if a party habitually works for various employers, the party is considered to be a contractor. An employee typically performs work personally, while an independent contractor may possibly appoint the work to employees or, in some cases, outside subcontractors. The legal status of the worker is taken into account because if the worker as incorporated their own business and carries out the contract under the business name, the worker would more than likely be viewed as an independent contractor. In consideration of public image, the relationship will bear a resemblance to employee status if the worker’s impression to their coworkers and the general public is reflective of a regular employee. In regard to official contractual portrayals of employment relationships, courts look at the â€Å"economic realities† of the relationship in use. Additionally, there is no Canadian law that prevents any parties employed part time, casually, at home, or through an employment agency from being viewed as an employee (England, 2008, pp. 20-22; Filsinger, 2010, p. 78; Flanagan, Ravary Boyd, 2005, pp. 1-2). It is argued that the tests currently used to determine employee status are insufficient because they do not include many of the workers who require the protection of the legislation due to their susceptibility to employers. Current tests assume a broad understanding that can depict the majority of relationships of vulnerability; however some level of flexibility is not only inevitable, but also enviable. A more productive approach may be to add a new category of â€Å"dependent contractor† and stipulate which statutory and common law privileges are and are not appropriate for this new category (England, 2008, pp. 22-23). The 1997 Supreme Court of Canada case, Pointe-Claire v. Quebec, had great influence over the tests used in the determination of an employment contract, especially in the situation of determining who the employer is in a tripartite setting. In the case, Pointe-Claire hired an employee through an employment agency. The employee’s wages were paid via the agency, but the employee worked under the supervision of a city manager. The court determined that the most suitable approach for this case was to consider the factors relevant to the employer-employee relationship, which led to the resolve that the employee was in fact an employee of the city of Pointe-Claire (Foster, n. d. , Lesson 4). In short, the Supreme Court of Canada held that the core of a worker-employer relationship in a tripartite situation is control over working conditions, which requires deliberation of which party has control over the selection, hiring, remuneration, discipline, training, evaluation, assignment of duties, and working conditions of the worker. The degree to which the worker is incorporated into the business as well as the worker’s tenure was considered as well. One of the most critical aspects of this case is the knowledge that even if an employee is placed through an employment agency, the employee may still be considered an employee of that employer. In this case, the employee was predominantly viewed as an employee of the City because of the control it exercised over the employee – more so than the employment agency. However, elements such as remuneration, stipulations of equipment, work obligations, hours of work, income tax deductions, and the assignment of work were also considered to establish who the employee’s employer truly was (Foster, n. d. , Lesson 4). The Supreme Court of Canada concluded that the City was the employee’s employer since the City performed many of the conventional aspects of an employer, and because the employee had the same conditions of work as the City’s other employees – ultimately, the employee performed her work within a system created by the City rather than the employment agency (Pointe-Claire v. Quebec, 1997, p. 1029-1030). Employment contracts tend to be vague, resulting in the need for routing of fundamental terms and conditions to deter ambiguity in the future. When negotiating an employment contract, the terms included cannot breach minimum statutory standards, must not be viewed as imbalanced and are required to truthfully exhibit the type of work performed (Foster, n. d. , Lesson 7). Terms typically included in employment contracts include the following: job description, remuneration, employment term, termination clause, probationary period, relocation expectations, benefits, restrictive covenants (including non-disclosure, non-solicitation, and non-competition clauses), ownership of intellectual property clauses, choice of law, corporate policies, entire agreement clause, inducement, independent legal advice, severability clause, and golden parachute (Filsinger, 2010, pp. 96-105). A written employment contract is more advantageous than an oral agreement for many reasons. A written contract lessens the risk of any misunderstandings, speaks to any litigious issues early on in the relationship, and limits the amount of uncertainty (Filsinger, 2010, p. 89). Since there is no way in which to include every possible occurrence over the course of the relationship, employees and their council must make certain that the contract is unambiguous and should pay tribute to how the terms within the contract may be interpreted (Foster, n. d. , Lesson 7). When a dispute arises regarding an issue not addressed in a contract, a court introduces â€Å"implied terms† into the agreement, meaning the court deems which terms would likely have been included in the contract if the parties had negotiated the disputed issue and regards those terms to be included in the employment contract (Filsinger, 2012, p. 90). If a party is unsatisfied with the terms included in their employment contract, they are able to question the contract’s enforceability by claiming the contract entailed a lack of consideration, inequality of bargaining power, obsolesce, the failure to abide by minimum statutory standards, or the use of ambiguous language. Consideration is typically given by the pledged exchange of payment for work performed, which results in issues if an employee begins work before the contract is settled. To avoid this situation, employers should ensure the employment agreement is concluded before the employee is scheduled to begin work. Employment contracts can be questioned if a party feels an inequality of bargaining power existed during contract negotiations. To decrease the risk of this problem, employers should make certain the contract terms demonstrate a realistic balance between both parties’ interests, present the candidate with a copy of the anticipated contract for review, incorporate a condition outlining that the candidate had the chance to obtain legal advice upon signing the contract, and make the candidate aware of key terms and have the candidate initial them to demonstrate understanding and acceptance. If the contract no longer reflects the employee’s actual responsibilities, the contract can be challenged on the ground of obsolescence. Employers should bring up to date the employment agreement when necessary. If the contract does not meet the minimum statutory standards, the contract terms will be deemed null and void. Lastly, if a court finds the contract terms to be ambiguous, it may apply the contra proferentem rule, meaning the ambiguous language may be construed against the party who created the contract since the party could have eluded the issue by using more clear language (Filsinger, 2010, pp. 91-95).

Patients who persistently resisted or caused trouble might be threatened with punishment if they did not control themselves. He argued that psychological intervention must be tailored to each individual rather than to a diagnostic category, and must be grounded in an understanding of their perspective and history. Pinels psychiatric therapeutics, his traitement moral, represented the first attempt at individual psychotherapy. His treatment was marked by gentleness, understanding, and goodwill. How to Identify Prepositional Phrases

How to Identify Prepositional Phrases Prepositional phrases are a central part of virtually every sentence spoken or written. Simply put, they always consist of a preposition and an object or objects of the preposition. So its good to get acquainted with this essential part of a sentence and how it affects your writing style. Here is the first paragraph of Chapter 29 of John Steinbecks famous novel The Grapes of Wrath, published in 1939. As you read this paragraph, see if you can identify all the prepositional phrases used by Steinbeck to convey the dramatic return of rain after a long, painful drought. When youre finished, compare your results with the second version of the paragraph, in which prepositional phrases are highlighted in italics. Steinbecks Original Paragraph in The Grapes of Wrath Over the high coast mountains and over the valleys the gray clouds marched in from the ocean. The wind blew fiercely and silently, high in the air, and it swished in the brush, and it roared in the forests. The clouds came in brokenly, in puffs, in folds, in gray crags; and they piled in together and settled low over the west. And then the wind stopped and left the clouds deep and solid. The rain began with gusty showers, pauses and downpours; and then gradually it settled to a single tempo, small drops and a steady beat, rain that was gray to see through, rain that cut midday light to evening. And at first the dry earth sucked the moisture down and blackened. For two days the earth drank the rain, until the earth was full. Then puddles formed, and in the low places little lakes formed in the fields. The muddy lakes rose higher, and the steady rain whipped the shining water. At last the mountains were full, and the hillsides spilled into the streams, built them to freshets, and sent them roaring down the canyons into the valleys. The rain beat on steadily. And the streams and the little rivers edged up to the bank sides and worked at willows and tree roots, bent the willows deep in the current, cut out the roots of cotton-woods and brought down the trees. The muddy water whirled along the bank sides and crept up the banks until at last it spilled over, into the fields, into the orchards, into the cotton patches where the black stems stood. Level fields became lakes, broad and gray, and the rain whipped up the surfaces. Then the water poured over the highways, and cars moved slowly, cutting the water ahead, and leaving a boiling muddy wake behind. The earth whispered under the beat of the rain, and the streams thundered under the churning freshets. When you have completed the identification exercise in the original paragraph, compare your results with this marked version. Yahoo case study Essay Example | Topics and Well Written Essays - 2250 words

Yahoo case study - Essay Example But yahoo was not able to carry on the fame it had created for long time. In February 2008, yahoo share price fell from $31 a share to less than half of it. In the year 2011, the CEO of Yahoo Carol Bartz was sacked by the chairman of the company. However the share price of Yahoo had plummeted during the tenure of Carol Bartz. Analysis of the case The case study takes into consideration the problems and issues which Yahoo has been facing over the years. Initially the company was able to attract customers but with new competition from other online sites, yahoo started to losing its customers. According to the case study Yahoo lacked the hype and buzz in the technology market. The case study has also introduced many issues and problems that the company was facing along with its employees such as the corporate culture and political conflicts which highlighted the problem that the employees were dissatisfied with the mid level management; the organization was involved in silo thinking and bureaucracy, issue with respect to human resource, leadership changes and restructuring. In addition to the problems faced by Yahoo, the case study also talks about change in leadership. Marissa Mayer who was the head of the Google search group was appointed as the new CEO of Yahoo. Under the leadership of Marissa Mayer, change management has been implemented to get back Yahoo on the right track and Marissa Mayer aims to â€Å"focus on the users† as yahoo in recent years have been known for its distraction than delight. The case study shows how Marissa Mayer implemented the strategy of change management in yahoo and also follows the changes and step that she brought in Google. The case highlights the good and potential qualities of Marissa Mayer to bring about a change in Yahoo but at the same time it also highlights the resistance to change that the employees of Yahoo might face while dealing with the change. Identification of major issues Yahoo major problem was it never b een best at anything and instead of defining itself the company has fitted from one new web portal to another. Yahoo has 44 different business units and with just 3200 employees it had become unmanageable for the company. Despite having about 44 different business units it do not have sales unit leading to much more confused and chaotic situations. During the golden days of Yahoo, customers were getting involved with the company by themselves and the advertisement company was ready to spent dollars on it and as a result Yahoo did not established relationship with its customers as the customers walked it by themselves which led to arrogance (Willians 2008, 209)1 Corporate culture and political conflicts are said to be high in the organization and this can be seen another big issue for Yahoo and the new CEO Marissa Mayer. As per a review it was revealed that in comparisons to 98% of Google employees who thought the outlook of the company will be better in the future only 48% of employ ees of Yahoo felt the same. The employees were not satisfied with the mid level management as the mid level management was control freaks who pressurized the people without making any improvement. Parliamentary System VS Presidential System Essay

Parliamentary System VS Presidential System - Essay Example This research will begin with the statement that democratic governments are those that permit the nation's citizens to manage their government either directly or through elected representatives. This is opposed to authoritarian governments that limit or prohibit the direct participation of its citizens. Different types of political systems prevailing in the current world. Broadly speaking, based on the nature of functioning the entire political systems in the world can be classified into tow; democratic systems and totalitarian systems. Communism in China and some of the autocratic Islamic administrations in countries like Saudi Arabia, Kuwait, UAE etc are examples of totalitarian administrations. On the other hand, in countries like America, Canada, UK, India etc; democratic administrations are functioning even though these administrations differ somewhat in its core areas of functioning. Since the fall of Soviet Union and the subsequent fall of communist regimes in Easter Europe, d emocracy is gaining prominence in world politics. Parliamentary system and presidential system are the two major categories under the democratic political system. Judiciary, Parliament and Executive are the three major pillars upon which a democratic political system works. The nature of functioning of these three pillars would be different in parliamentary and presidential political systems. Canada, India, etc are some of the countries in which parliamentary democracy prevails whereas in America presidential system of democracy is in operation.... There are many other differences between parliamentary system and presidential system. Canada, India, etc are some of the countries in which parliamentary democracy prevails whereas in America presidential system of democracy is in operation. This paper compares the parliamentary system and presidential system taking Canada and America as examples. Differences between parliamentary system and presidential system In a parliamentary system, government cannot function against the will of parliament. Both the prime minister and his cabinet are accountable to parliament. They cannot function independently or without seeking the opinion of the parliament, while taking decisions and formulating policies. All the governmental policies should be presented and discussed in the parliament comprehensively before the implementation stage. Governments in parliamentary system cannot implement any policies without the approval of the parliament. In most of the cases, parliament approves all the bill s presented since the ruling government have majority in the parliament. In short, prime minister and his/her cabinet are accountable to the parliament in parliamentary democracy. On the other hand in countries like America where presidential system prevails, president enjoys slightly more power over the parliament or congress. American president has the authority to veto any of the decisions taken by the Congress, even though in most of the cases, the president functions in line with the decisions taken by the Congress. Since countries like Canada, Australia, New Zealand etc were British colonies earlier; the governments in these countries are functioning slightly differently even though

Iraq War Essay Example for Free

Iraq War Essay The Iraq War has attracted news coverage from around the world. Various television stations in countries like the US and the UK have news correspondents and news bureaus in the area to cover war-related updates and happenings. However, there were concerns on how media frames and delivers their news. Most of these news reports are accused of being biased, choosing to show only the negative aspects of the war. Two authors have written about this occurrence. One of them points out that most of the stories that reaches the audience is negative, while the other one points out the flaws reporting only the good aspects of war. By critically analyzing these two articles, it is possible to gain useful information as to why the news coverage in Iraq are framed as such. The first article is The Real Iraq Story by Karl Zinsmeister. This talks about the bias towards negative news by the foreign news coverage (Zinsmeister, 2004). It cites certain examples of bad news coverage in Iraq. From the plight of detainees in an Iraqi prison to the power shortages in Iraqi towns and cities, foreign news teams like CNN and BBC clearly chose to report on the negative aspects of certain topics. According to Zinmeister, this type of media coverage clearly affects how people around the world see the Iraq war. By showing mostly the negative aspects of the war, people tend to overlook its purpose. By showing the prison conditions of the detainees, the people are more drawn to the cruelties of war, instead of thinking who these detainees were. On the other hand, Phillip Carter’s The dark side of Iraq’s good news talks about the bias on the good news by recent Iraqi reports (Carter, 2007). These are more recent than the bias on negative news by foreign news correspondents, and these were reported by the Iraqi media. These reports are mostly about the declining Iraqi civilian death toll, increasing number of Iraqis joining US military to secure neighborhoods, and the capture of top insurgent leaders. Despite the majority of the good news, the author argues that focusing on these topics may mislead the people. They could develop a false sense of security, which would just worsen their situation. Going back to Zinsmeister article, we can assume that there is a motive behind the mostly negative news coverage. As the war continues, more and more people are starting to oppose it, doubting the intentions of those who are pursuing it. Political leaders like US President George W. Bush attracted the opposition of the international community because of the US occupation of Iraq in relation to his war on terror. If we relate this to the negative news coverage in Iraq, then it is possible that this is one way of opposing those who pursue this war. News coverage like this clearly draws out the sympathy of the people, especially if they continue to see its negative side. On the other hand, the mostly positive Iraqi news coverage could mean the opposite. By reporting only the good news, the media are trying to build up a positive image for Iraq. By reporting every improving statistic and leaving out the negative ones, people can be lulled to believing that indeed, Iraq has improved greatly. However, with mostly the positive news being covered, it seems that the Iraqi media are overdoing it and would appear that they’re just covering up the real scenario (Kelly, 2007). Moreover, this faulty news coverage had the international community thinking: can the Iraqi people really do it? Will they be able to stand on their own after the war? References: Carter, P. (2007). Roswell Conspiracy Essays -- History, Spaceship, Cover up

What really happened over the summer in 1947 in Roswell, New Mexico? People have debated this topic countless times. Despite all of the deviations of what happened, there is a general timeline. Sometime during the months of June and July 1947, an aircraft landed in Mac Brazel’s ranch; Brazel proceeded to tell Sheriff George Wilcox. He sent a member of the Roswell Army Air Field base to look at the wreckage on Brazel’s ranch. This person took some of the debris back to the base for further inspection. On July 8, 1947, the newspapers published stories about how someone found a flying saucer in New Mexico. However, the government told the newspapers to report that it was merely a weather balloon that had crashed. After that, everybody simply accepted the story and dropped the topic. Throughout that story, many pieces of evidence went untold to the media. There were numerous pictures that went unreleased. Many affidavits went unnoticed and nobody paid attention t o inconsistencies in the government’s justifications. Because of explicative photographs, several eyewitness accounts, and contradictory government explanations, there is extensive proof that the government concealed an alien landing in Roswell, New Mexico. There are many detailed, certified photos that disclose evidence that there was a spacecraft crash in Roswell in 1947. One vital photograph was of the Ramey memo. The Associated Press took this photograph on July 8, 1947, six days after the alleged sightings. Brigadier General Roger Ramey was looking over the apparent debris from the crash with Colonel Thomas Dubose. A slip of paper hung out of Ramey’s pocket in this photograph. Due to technological advancements, the paper is mostly legible. Computers ha... ...ary knew about the crash and that they were going to transport the wreckage to another military base. Many eyewitness accounts with similar details eliminate the possibility of merely a single person making up the entire event. The government’s contradictory reports demonstrate that their knowledge of the incident is dynamic and dependent on how they want the people to react. This matter is important because it raises the possibility that if the government is hiding information from the public about a spacecraft accident, there may be other incidents where the government is concealing the truth from the public. Despite the government’s best attempts to cover up the Roswell incident, eyewitness accounts from the common person validate the idea that an unidentified flying object crashed in Roswell, New Mexico and eternally changed the lives of several people. Love in Like Water for Chocolate Essay

Have you ever experienced that euphoric sensation after eating an absolutely delicious food? You are not alone. Many have experienced this feeling and refer to it as a â€Å"foodgasm†. These types of connections between food and sex have long been established, but from where do they come? Do we make these connections through our cultural experiences or are they biologically programmed within us? In Like Water for Chocolate, the author, Laura Esquivel, portrays sex and food as being connected in a cultural sense. The basis for this conclusion rests largely in her use of tradition and her depiction of a Latino family strongly based in their culture. This cultural foundation, paired with the interactions between characters, food, and sex, gives the reader plenty of evidence to support this perspective. Esquivel uses the preparation, eating, and serving of food as a connection to love and sex, and as humans we have learned, through culture, to make this connection. Structured in twelve chapters, each representing a month of the year, Esquivel has created an entrancing love story that is sprinkled with culinary enchantments around every corner. Each chapter is prefaced with a recipe that is relevant to the progression of the novel, not to mention the many cooking tid-bits thrown in throughout each chapter. The preparation of food is clearly very important to the culture being represented. Tita, the main character and protagonist, was born in the kitchen and possesses all the superior traits of a culinary expert. She is also blessed (or cursed) with the ability to inject her emotions in to the food she cooks, in turn, infecting all those who consume the food with that emotion. In one section of the novel, Tita makes Quail, in Rose Petal Sauce, to express her passion for her sister, Rasaura’s, husband, Pedro, who she is deeply in love with. With that meal it seemed they had discovered a new system of communication, in which Tita was the transmitter, Pedro the receiver†¦ Pedro didn’t offer any resistance. He let Tita penetrate to the farthest corners of his being, and all the while they couldn’t take their eyes off each other. (Esquivel 52) It is customary, in many cultures, for a woman to prepare a meal for her significant other in order to show how much she cares for him. The fact that Tita has taken the time to cook such a complex and beautiful dish, to translate her love to Pedro, shows how much impact this cultural custom has on her. Through this particular interaction, Esquivel has displayed the influence that culture has over the preparation of food and it’s relation to love. The expectation for a woman to acquire the ability to prepare food for her significant other brings me to another question: Does a woman’s capacity for cooking significantly affect a man’s attraction to her? Esquivel brings this question to the forefront of the reader’s mind when she offers this comparison between Rasaura and Tita’s cooking. The rice was obviously scorched, the meat dried out, the dessert burnt. But no one at the table dared display the tiniest hint of displeasure, not after Mama Elena had pointedly remarked: ‘As the first meal that Rosaura has cooked it isn’t bad. Don’t you agree, Pedro? ’ Making a real effort not to insult his wife, Pedro replied: ‘No, for her first time it’s not too bad. ’ (50-51) She goes on to show Pedro’s reaction to Tita’s cooking saying, â€Å"It wasn’t enough he’d made his wife jealous earlier, for when Pedro tasted his first mouthful, he couldn’t help closing his eyes in voluptuous delight and exclaiming: ‘It is a dish for the gods! ’†(51). This comparison allows us to reasonably assume that Tita’s aptitude for culinary artistry did contribute to the growth of Pedro’s love. So, how might this reaction be culturally habituated? In almost all cultures, men are expected to provide and women are expected to cook. Even if a man is not consciously aware, they subconsciously factor this in to their choosing of a mate. It is culturally conditioned for a man to prioritize supporting his family over many other things. If a woman does not possess the ability to cook then a man may assume that she will not be able to support or provide for their family. This, of course, is not a strict rule of thought but, from my experience, it can be applied to many cases. Through comparison, Esquivel gives the reader evidence that Pedro loves Tita partially for her ability in the kitchen, and with prior knowledge we, as the reader, can attribute this connection to his cultural influences. We’ve determined that falling in love can be related to a woman’s ability to make food, but what about the relationship between food and making love? Earlier I made a reference to the word â€Å"foodgasm†, this portion of a quote, which I previously used, provides a great example of what a foodgasm might look like. â€Å"†¦ for when Pedro tasted his first mouthful, he couldn’t help closing his eyes in voluptuous delight and exclaiming: ‘It is a dish for the gods! ’†(Esquivel 51) It is instances like this one that finds Esquivel nudging the reader to make a connection between food and sex. Esquivel’s use of diction such as ‘voluptuous’ makes it practically impossible not to connect this experience to the effects of an orgasm. Thinking further on this connection, I think that giving food is a form of showing love just as making love is. As raunchy as it may seem, Pedro is receiving Tita through food. It is their unique form of making love. Esquivel makes another food/love connection on page 67 when she says, â€Å"Tita knew through her own flesh how fire transforms a tortilla, how a soul that hasn’t been warmed by the fire of love is lifeless, like a useless ball of corn flour. †(67) It’s almost as if Esquivel allows characters, in this case Tita, to take on the form of food. With this being said, receiving food is like receiving the person who made it. In Tita and Pedro’s case, it was their way of making love before they could actually perform the act. I think that the importance of food to their relationship can be contributed to their culture’s emphasis on food. If food were not so important to their culture it would not be the medium for such an important interaction. In order to make and express love in Like Water for Chocolate, Tita makes food for Pedro further emphasizing the cultural connection between food and love. Some may argue that this relationship between food and sex is purely natural and scientific. In some sense this is true. Sex and Food are both biologically programmed drives that all humans possess. We have a strong need to procreate in order to further our species as well as a great need to eat in order to survive. These are facts of nature, but you can’t ignore the emotional connection that we have to food and sex. Tita and Pedro do not have these reactions to food in relation to sex simply because they need to eat or they have a great need to reproduce. Culture conditions us to eat because we love food not to simply eat to live. The same goes for sex. We are taught that in order to have sex one must have a connection to their partner; it is â€Å"morally sound† to think this way. This is especially true for the culture being represented in Like Water for Chocolate. Just in the way that Esquivel structures the novel you can get a sense of the importance food. The food must be treated with respect and love just as a person should be. Esquivel shows the significance of treating food well here: Something strange was going on. Tita remembered that Nacha had always said that when people argue while preparing tamales, the tamales won’t get cooked. They can be heated day after day and still stay raw, because the tamales are angry. In a case like that, you have to sing to them, which makes them happy; then they’ll cook. ‘(218-219) Esquivel’s personification of food demonstrates the meaning that food holds in this culture. It has feelings and you have to love it and nurture it. You don’t just eat food to eat it; you eat food because food is a beautiful part of life that you respect. In this way, Esquivel creates a strong connection between food and love through the cultural importance that the novel puts on the meaning of food rather than the natural tendency of humans to make this connection. After analyzing Esquivel’s novel, Like Water for Chocolate, I can say that the connection between food, sex, and love, in this context, is predominately based on cultural influences rather than natural ones. In making food, one is showing how much they care, just as Tita did for Pedro with her Quale in Rose pedal sauce dish. The ability to create such meals, in a man’s mind, is a reflection on a woman’s ability to provide for their family. By personifying food, Esquivel allows this process of cooking food and giving food to become much deeper than the simple act itself. The act of giving food then takes the form of giving ones self to the individual receiving the food. Whether it is between food and love, cooking and falling in love, or eating food and making love, culture is the force that defines these connections. Works Cited Esquivel, Laura. Addendum to the Risk Assessment Matrix Essay

Description of Risks Impact Likelihood of Occurrence (L,M,H) Degree of Impact (L,M,H) Initial Action to Take if Event Occurs Team Member Responsible Strategies for Prevention and Mitigation Widespread security breach due to unauthorized access to sensitive customer information. Negative publicity of the company and loss of credibility in the eyes of existing and potential customers impacting overall business. Take immediate action to tighten security including all employee access to customer sensitive information. Identify and install the latest security software on all telecommuters’ PCs and enforce strict rules for information access including password policy management. Document Server integration challenges. The setup of the environment for the Telecommuters would be delayed. roubleshoot remotely to identify the root of the integration issue. The repetitive process of installation and setup of the document servers can be potentially scripted and semi-automated to minimize error and reduce time taken. Technical challenges such as power failure and internet connection outages. The setup of the environment for the Telecommuters would be delayed if either power or internet connection were impacted. Guidelines can cover instructions to move on to the next computer to setup and return to the remote PC with power or internet challenges later.PhoebeTo prevent and mitigate this risk, the telecommuter PCs can be staged and setup in the Xemba Translations office before shipping to the remote l ocation. In the long term budget can be allocated for individual battery backup for the remote PCs Delay in completion of the Telecommuting Expansion projectInadequate resources available to address the increased customer need causing negative publicity of the company. Increase the project team size to catch up and speed up progress reducing potential for any further schedule impact.Project TeamManage schedules even more tightly monitoring daily progress of tasks and mitigating schedule delays even before it occurs. Perception of impersonal and below par service due to telecommuters Though there is a subjective aspect to this risk it can lead to the loss of very real customers and negative publicity. Focus can be shifted to the lost customers to survey the reason for them to take business elsewhere and offer  incentives to return. Work with the marketing team to ensure the message is clear to large customers on the benefits of real-time web based communications and translation ser vices. Task B: Explanation of Metrics: The metrics that can be effectively used to clearly and effectively measure the progress and overall project health of this Telecommuter Expansion project is â€Å"Earned Value Management†. It is a commonly used technique that factors in the cost and schedule baselines and then uses simple indices to estimate and measure where the project is in reference to the respective projected baselines that were set at the beginning of the project. Earned Value Management relies on three key metrics: – Planned Value (PV): This is the official budget that has been allocated to the project. The budget is typically setup per phase of the project, but at any point in time the â€Å"Planned Value† is used to refer to the work that should have been completed. The total planned value for the project is also referred to as the â€Å"Budget at Completion† (BAC) – Earned Value (EV): The Earned Value refers to the amount of work that would need to be completed at any point in time in for the project to be considered to be on track. The Earned Value is often used to calculate the percent complete for any project. The formula for percent complete would be: % Complete = EV / BAC. – Actual Cost (AC): The Actual Cost would quite simply be the costs that have been incurred to accomplish all the work performed thus far in a project. Technically the AC will have no upper limit and translates always to what was budgeted in the PV and measured by the EV. Part of the Earned Value Management technique is the monitoring of variances from the approved baseline of costs and schedule. The variances are useful in determining the overall project health and status. – Schedule Variance (SV): The Schedule Variance indicates a value which is a measure of how much the project is either ahead or behind at a given point in time. For any given point in time, once the EV and PV are known the SV can easily be calculated. The formu la for SV is quite simply: SV = EV – PV. Here a positive value indicates that the project is ahead at the current point in time and a negative value would indicate the opposite that a project is behind at the current point in time. – Cost Variance (CV): The Cost Variance indicates a value which is a measure of how much the project is either overspent or  underspent at any given point in time. For any given point in time, once the EV and AC are known the CV can easily be calculated. The formula for CV is quite simply: CV = EV – AC. Here a positive value indicates that the project is under spent at the current point in time and a negative value would indicate the opposite that a project is over spent at the current point in time. The Cost Variance at the end of the project is calculated as follows: CV = BAC – AC. The same above rationale is applied to positive and negative numbers to indicate if the project is under spent or over spent respectively. To me asure schedule or cost efficiency there are two indices which are also computed as part of the Earned Value Management technique. They are Schedule Performance Index and Cost Performance Index. – Schedule Performance Index (SPI): This is a measure of how efficiently the project has been run till the current point in time. An SPI of less than 1.0 would indicate that less work was completed than originally planned and an SPI value greater than 1.0 would indicate that more work was completed than was originally planned. The SPI is calculated with the following formula: SPI = EV / PV – Cost Performance Index (CPI): This is a measure of how efficiently the project has been run in terms of budgeted resources till the current point in time. The CPI is considered the most critical metric of the Earned Value Management methodology. A CPI of less than 1.0 would indicate that the project is currently over budget than originally planned and a CPI value of greater than 1.0 would in dicate that the project is currently under budget and in good shape. The CPI is calculated with the following formula: CPI = EV / AC Task B1: Justification of Metrics: One of the primary reasons of choosing the Earned Value Management methodology for the tracking of the project metrics of the Telecommuting Expansion Project was due to the fact that this method comprehensively covers all the key aspects of Project Schedule Control and Cost Management. With the use of this approach a well-rounded analysis can be performed on the data provided. The data provided has the clear value for the budget at completion (BAC) for all the labor costs for the project as well. The Cash Flow Report provided in the case study provides a good reference of the Earned Value at the 76 day mark within week 11. The Status Reports that are provided at the end of the Case Study also provides the  detailed actual sunk costs for each work package covered in the project work breakdown structure. Using the details provided, the Cost and Schedule Variances can easily be calculated which would easily offer a detailed look at the overall projec t health in regards to schedule and cost. With a simple arithmetic calculation one can easily determine whether the project is on track to stay under budget or go over budget as well as determine whether the project is going to stay on track and complete on schedule, or early or late. Also, with the calculation of the Cost Performance Index and the Schedule Performance Index, the schedule efficiency and cost efficiency of the Project can be easily evaluated. Comparing the two indices in reference to them being greater than 1.0 or lesser than 1.0 one can predict if the project is on track to come in under or over budget and finish ahead or behind schedule. This approach also fits well with the critical path approach that has been used thus far in the case study where special emphasis can be paid to the work packages in the critical path in an effort to further mitigate risk and control schedule and costs of the project. Using the formulas in the Earned Value Management technique, the final project cost and the final project duration can be estimated. Per the Case Study, the initial planned duration for the project is 123 days. †¢Estimated Final Project Cost = BAC / CPI = $ 173,329.40 / .91 = $ 190,471.87 †¢Estimated Final Project Duration = Planned Duration / SPI = 123 days / .59 = 209 days Note: Unless mitigated further the labor costs for the project will be around $ 17K more than planned and will finish around 86 days late. The additional costs for the project are the procurement costs for the hardware and software to support the 173 telecommuters. These would include the costs for the new computers that the telecommuters would use as well as the Document Servers, Shared Drives, FTP Servers, Firewalls and the support for Web-Based meetings. Based on the details provided in the Status Report by the previous project manager for the Xemba Translations Telecommuter Expansion Project, the total budgeted amount for all of these costs was $73,670.57. Per that same report the following table contains the estimated actual costs for those items. Per Xemba Translations CEO, Phuong Wolfing, the costs of the firewall could easily be absorbed into the overall IT budget rather than being accounted for as a project cost. This would imply that the hardware and software costs for the Telecommuter Expansion Project would total to $71,300 and come in under budget. Xemba Translations Senior Management and Stakeholders will need to decide on how to proceed here. Task B3a: Problems Affecting Project Implementation: A summary of three problems that could impact the project are as follows: One: Cost Overrun – Based on the current project status and trend of activities including estimates from the project team of how much more time is needed on the different project tasks, if there are no major changes, the Project will definitely run well over budget and require additional funding in order to be completed. This would mean that there would really need to be an even bigger effort by the new Project Manager to control costs to minimize the cost overruns. Since the planned project duration is 123 days, with 76 days of this project completed, this project should be approximately 62% completed. Till date, the Actual Cost (AC) for labor on the project is only $112,587. Looking at the Cash Flow Report which is part of the Baseline Project Report, it shows that on day 76, the Earned Value (EV) of the project should be around $125,000 with a Percent of Work Complete at approximately 72%. Calculating the Cost Performance Index (CPI) using the EV of $125,000 and AC of $112,587 would give us a value greater than 1.0 (1.12) which would indicate that the project is currently under budget. However, factoring in the new estimates of the amount of work remaining, the Percent of Work Remaining comes in at ~41% which would mean that the project is only 59% completed in terms of tasks. Using the â€Å"% complete† at 59% and the Planned Value (PV or BAC) of $173,329.40 we arrive at an EV of $102,587 with a negative CPI lesser than 1.0 (0.91) indicating a definite cost overrun if something is not done and the project costs are not controlled more tightly moving forward. Two: Schedule Overrun – Based on the current project status and trend of activities, if there are no major changes, the Project will definitely finish well beyond the targeted end date at the end of June in time for the start of the third quarter of the year as expected when the project was approved. This will imply that if Senior Management and Stakeholders of this project are serious on this project being completed in time for the third quarter of the year, then many critical steps will need to be taken to try and mitigate and minimize further project delay. There were many contributing factors leading to the delay. One of the biggest contributing factors for the delay in the project schedu le is the time lost in the pilot tests of the several web-based meetings that were planned and that needed to be re-scheduled due to the weather related power outage experienced in the Midwest. Another factor contributing to delay in the schedule is the procurement delay of the 47 new computers which were delayed by two weeks due to being â€Å"back-ordered. This contributed to a late start of the setup and validation of the 47 new computers for the telecommuters. As discussed in the â€Å"Project Status† section the Schedule Performance Index (SPI) is calculated to be 0.59. Since this value is below 1.0 this indicates  that the project is currently behind schedule and will most likely be completed much behind schedule if the factors contributing to the delay are not mitigated. There will need to be close attention to the items that are in the critical path to see if they can be accelerated to try and minimize delay moving forward. Three: Quality Challenges – The status report for the Telecommuter Expansion project that is included as part of the case study reveals that typically in any IT Project there are many factors which can easily drive down the quality of the solution that is being worked on. In this case for Xemba Translations the Telecommuter Expansion is a project which involves substantial capital investment in information technology infrastructure and the associated complexities of getting the infrastructure setup a nd functional. As with any complex technology solution, the most critical part involves the initial setup and verification of the complex solution especially in all the many edge cases where the solution’s resilience to security attacks and malicious users is tested. Something which is not specific just to this Telecommuter Expansion project is the strain on resources that is usually experienced in an extremely pronounced way when there are schedule related challenges in a project. This project is tremendously behind schedule and there are many important schedule related decisions which will need to be made as part of the overall progress on this project. Another item that absolutely cannot be ignored is the Quality Management of all the moving pieces of the project. For example, this project involves the setup of computers for 173 telecommuters which include setting up document server access for each of them, shared drives, FTP access and the necessary software and hardware to support a web-based meeting environment for each of the 173 telecommuters. While this seems a tall order for a group of 15 project team members, it adds additional strain when all this needs to be accomplished flawlessly when the project is already behind schedule. Typically when there are schedule related pressures, the tendency is to just complete an item without focusing much on quality. Given the technical complexity of the deliverables of this project compounded with the lack of enough resources, there needs to be steps taken to ensure overall quality of all the technical deliverables in the project are maintained at a high level for the successful completion of this project followed with the successful operation of daily activities in Xemba  Translations. Task B3b: Recommendations for Problem Mitigation: The following is a summary of the mitigation steps to address the above mentioned problems that could negatively impact the project. Although the problems that have been encountered thus far cannot be eliminated, moving forward in the project, till completion the same problems can be minimized or mitigated. Based on the current project status, if we the project is on day 76 out of a planned 123 days of project activity and have spent $112K out of a budgeted 173K, then there is a lot of room for tighter fiscal control and cost management. There needs to be processes in place to confirm and authorize the need for additional hours spent on an activity especially if that activity is behind schedule. For example, there has been substantial amount of time spent on the Web-Based Meetings pilot test. This is an activity where bad weather played a role in causing unexpected delays as well as unnecessary hours spent on an activity which yielded no results. Since we cannot turn back the clock here, moving forward on any planned end-to-end testing activity, there needs to be a quick go/no-go call to first discuss readiness for such activity. Also, there needs to be more diligence paid to estimation of task duration. Given that we have an actual track record of how long different task take, the activity can we more tightly estimated and the duration exactly planned for. This not only helps with cost estimation but also helps with scheduling control. As part of due diligence and planning, there can also be a â€Å"best practices review† organized by the Project Manager where the project team reviews best practices for a task that needs to be worked on and accomplished in the effort to further accelerate the rate of progress while also indirectly bringing in completion dates and shortening the schedule where possible. Given the revised estimates of the remaining 1220 hours of work left on the project, there is a great o pportunity to bring in those dates and reduce the hours spent as the same time. Also, authorization can be obtained from Senior Management on the potential of incentivizing the team with spot bonuses if budget can be allotted accordingly, in order to keep certain tight deadlines. This helps the team focus and work together to achieve the common goal. On another note on the topic of hours spent on the project by the project team, a process can be reviewed with the team and  proposals can be made to Senior Management weekly on whether overtime hours for employees who will be working their full 40 hours for the week can be authorized or not. This will not only keep a handle on costs due to overtime-pay, this will also prevent a certain element of â€Å"burnout† within the team where the team would feel overworked. Historically, overworked teams tend to make mistakes and produce low quality deliverables. Hence at all costs, team burnout will need to be avoided which would indir ectly also improve overall quality and team responsiveness. Quality can be very relative and subjective. In order to take out the subjectivity from quality measurement, the team can be asked to work together and come up with tangible metrics to measure the quality of all the technical deliverables that are worked on. This will serve in obtaining an unbiased and tangible view of the progress made on any of the technical deliverables and measure readiness of the solution that is being worked on. In general this same process can be applied to the processes used for setting up the new computers, document servers, shared drives, FTP sites as well as the web-based meeting software environment. Task C: Executive Summary: The Telecommuting Expansion project is well underway. Another Risk Analysis was performed and new risks have been identified and summarized in a Risk Assessment Matrix. A quick summary of the newly identified risks, its impact and strategies for prevention and mitigation are as follows: Description of Risks Impact Strategies for Prevention and Mitigation Widespread security breach due to unauthorized access to sensitive customer informationNegative publicity of the company and loss of credibility in the eyes of existing and potential customers impacting overall businessIdentify and install the latest security software on all telecommuters’ PCs and enforce strict rules for information access including password policy management. Document Server integration challengesThe setup of the environment for the Telecommuters would be delayedThe repetitive process of installation and setup of the document servers can be potentially scripted and semi-automated t o minimize error and reduce time taken. Technical challenges such as power failure and internet connection outagesThe setup of the environment for the Telecommuters would be delayed if either power or internet connection were impacted. To prevent  and mitigate this risk, the telecommuter PCs can be staged and setup in the Xemba Translations office before shipping to the remote location. In the long term budget can be allocated for individual battery backup for the remote PCs Delay in completion of the Telecommuting Expansion projectInadequate resources available to address the increased customer need causing negative publicity of the company.Manage schedules even more tightly monitoring daily progress of tasks and mitigating schedule delays even before it occurs. Perception of impersonal and below par service due to telecommuters Though there is a subjective aspect to this risk it can lead to the loss of very real customers and negative publicityWork with the marketing team to ens ure the message is clear to large customers on the benefits of real-time web based communications and translation services. The project is at day 76 since its inception. There have been some changes to the initial estimates of schedule and costs to the project. The Earned Value Management technique was used to compute some key schedule and budget metrics for comparison and strategic planning of the project. The following table has a summary of key initially planned and revised estimates of the Schedule and Budget items of the project: Schedule/Budget ItemInitially Planned Revised Estimates Duration in Days123 days209 days Duration in Hours2,693 hrs3,008 hrs Personnel Cost$173,329.40$190,471.87 Hardware/Software Cost$73,670.57$71,300.00 Note: There is additional firewall hardware and software cost of $20,000 which will be accounted for in the IT budget per guidance from CEO – Phuong Wolfing instead of being added to the Telecommuting Expansion Project costs. This cost is excluded in the estimates in the above table. In addition to the above revised estimates, an analysis was done on three problems that the project is facing and recommendations were summarized to address and mitigate the problems. The problems that were discussed and summarized in great detail together with recommendations to address the root of the respective problems are as follows: One: Cost Overrun – Based on the current  project status and trend of activities including estimates from the project team of how much more time is needed on the different project tasks, if there are no major changes, the Project will definitely run well over budget and require additional funding in order to be completed. This would mean that there would really need to be an even bigger effort by the new Project Manager to control costs to minimize the cost overruns. Three: Quality Challenges – The status report for the Telecommuter Expansion project that is included as part of the case study reveals that typically in any IT Project there are many factors which can easily drive down the quality of the solution that is being worked on. The recommendations to address the problems facing the project are as follows: Authorization for additional work: There needs to be processes in place to confirm and authorize the need for additional hours spent on an activity especially if that activity is  behind schedule. Since we cannot turn back the clock here and undo any issues already experienced, moving forward on any planned end-to-end testing activity, there needs to be a quick go/no-go call to first discuss readiness for such activity. Accuracy of Task Estimation with Best Practices: Also, there needs to be more diligence paid to estimation of task duration. With all of the above listed recommendations in place this would not only pave the way for the successful completion of the Telecommuting Expansion Project but set a very bold precedent within Xemba Translations as to what to do and what not to do in a project. The successful completion of the Telecommuting Expansion Project  would set a strong foundation for Xemba Translations to handle the additional business that is forecasted starting in Q3.

Driving Over the Age Limit The elderly should not be allowed to retain their licenses after reaching a certain age. The elderly have problems that can effect the safety of other motorists. Problems with sight, judgement, and reflexes can effect elderly motorists on a daily basis. Elderly drivers also lack the ability to judge the speed of on-coming traffic. These problems will not only effect the elderly drivers, they will effect motorists of all ages. To prevent harm to other motorists, companies like Acess-a-Ride are available as an alternative to driving for senior citizens. Elderly drivers should be forced to surrender their licenses at a certain age. As a licensed driver, you are expected to drive cautiously and be prepared to react quickly. Elderly drivers cause concern in this area because their reflexes are not as quick as younger drivers’ reflexes are. Elderly drivers lack the ability to maneuver around or past dangerous situations. Dangerous situations can occur anywhere while driving, on local streets or highways. Reflexes are important to have if another driver suddenly cuts off an elderly motorist, and they have to swerve or stop short to prevent a collision. In a situation where seconds could mean the difference between impact with another vehicle reflexes mean everything. Protagonist vs. Antagonist Understanding a Storys Main Characters

Protagonist vs. Antagonist Understanding a Storys Main Characters Protagonist vs. Antagonist: Understanding a Story's Main Characters If there’s one thing every story needs, it’s conflict. And while conflict can take many forms (Self vs. Nature, Technology vs. Humanity, Character vs. Self, etc.), some of literature’s most beloved stories include conflict in the classic form of the protagonist and antagonist.Without the white whale, Moby Dick is just a book about a guy who goes sailing and then returns home. If there were no Harry Potter, then J.K. Rowling would have written a series about Voldemort taking over the world, unopposed. Without Sauron and the Ring, the Fellowship would have merely been an odd sight-seeing group touring Middle-earth. And as enjoyable as that may have been for  them,  it wouldn't have made a very good story for the rest of us.In this article, we will look at what protagonists and antagonists are, how these age-old character archetypes can help you craft memorable stories, and what famous rivalries look like in both literature and film. With that in mind, let's firs t go back to basics to figure out what exactly protagonists and antagonists are. What is a Protagonist? The protagonist is the main character whose story is being told. The term derives from classical Greek drama and literally means â€Å"first actor.† Though often referred to as the hero of the story, the main character isn’t necessarily virtuous, and also may be just one of many protagonists in the narrative.Because protagonists can take many forms, let's take a look at four common types of protagonists in action.4 Types of Protagonists1. The Lonely HeroThe Lonely Hero is the standard strain of protagonist, probably because it's seen as the most "heroic" type. As the name implies, the Lonely Hero is the one and only person who can stop evil from triumphing and save the day. Though they’re almost always helped by a team of supporting characters, the ultimate burden of the quest falls squarely on the shoulders of the Lonely Hero. They are the one who must sacrific e the most in order to accomplish their goal.Examples of Lonely Hero protagonists:Harry from  Harry PotterKatniss Everdeen from  The Hunger GamesFrodo Baggins from  Lord of the RingsMatilda from MatildaCooper from Interstellar So evil that all the heroes in the galaxy have to band together against him. (Image: Walt Disney Studios)Whether you have the traditional hero-villain character dynamic, or a non-traditional character rivalry, remember to make full use of the conflict their interactions generate in order to move your story along. By creating complex characters, you will find it much easier to develop an interesting plot and bring your story to life.SummaryIn any story, how can you tell if someone is a protagonist or an antagonist? They are both significant characters, but the easy distinction is that:The protagonist is always the main character, regardless of they are heroic. The antagonist isn't always evil or a villain, simply the character who is in opposition to the protagonist. With that distinction in mind, why not go ahead and create your own characters who are worthy of joining Frodo and Thanos in the pantheon of great protagonists and antagonists?Do you have a favorite protagonist? A favorite antagonist? What are your favorite protagonist vs. antagonist rivalries? Let us know in the comments below!
